1. Scope
1.1These terms apply to all orders on nobordersim.com between you and Karwan Ventures B.V., Het Eeuwsel 57, 5612 AS Eindhoven, Netherlands, trading under the brand NoBorderSim ("we").
1.2Our offers are aimed at consumers. If you buy for a business, these terms apply as well.
2. What you buy from us
2.1You buy a mobile data package for the destination you choose, either a country or a region such as Europe, for the number of days you choose. You use the package through an eSIM, a digital SIM profile that you install on your phone or tablet.
2.2The plan contains mobile data only. A phone number, and calls and text messages over the mobile network, are not included. Apps such as WhatsApp work over the data connection. You can keep your own SIM with your number at the same time.
2.3How many GB you can use at full speed each day, and how fast you can keep browsing after that until the next day, is shown with your package and in your confirmation. For a package covering several countries, this daily amount applies to all countries together. A new day starts every 24 hours, counted from your first connection. Details are on our fair use page.
2.4The days you booked start with your first data connection in a country covered by your package. After that, the days run without interruption, even if you do not use the eSIM. The plan ends automatically after the number of days booked. It is not a subscription and does not renew.
2.5You must install the eSIM by 180 days after purchase at the latest and connect for the first time in a country covered by your package. The exact date is in your confirmation. After that, the package expires.
2.6You cannot add days or data. If you need more days, you buy a new eSIM.
2.7The connection runs over partner networks in the countries of your package. Which countries and networks these are is shown with your package. Coverage and speed depend on the local network, your location and your device. The IP address of your connection may be in a different country from the one you are in.
2.8You need a device that supports eSIM and is not locked to a provider (SIM lock). You can check on our website before buying whether your device is compatible. Each eSIM can only be installed on one device. If you delete the eSIM from your device, it cannot be installed again.
3. Ordering and conclusion of the contract
3.1The plans on our website are not yet a binding offer.
3.2You choose the destination, the number of days and the number of eSIMs, enter your email address and choose a payment method. Right before buying, you see all details and the total price at a glance. Until then you can correct input errors at any time or change them with the back arrow. By clicking "Buy now" you make a binding offer.
3.3The contract is concluded when we show you the eSIM on your order page or send it to you by email, whichever happens first.
3.4You can conclude the contract in German, English or Turkish.
3.5We store the text of the contract. You can see your order at any time through the personal link in your confirmation email. You can view, print and save these terms here at any time.
4. Prices and payment
4.1All prices are final prices in euros and include statutory VAT. There are no other costs, for example for shipping.
4.2You can pay with PayPal, Apple Pay, Google Pay or credit card, and in some countries also with a payment method that is common there, such as iDEAL | Wero. Which payment methods you see depends on your country and your device. Payments are processed by our payment provider Stripe. Payment is due when you place your order.
4.3You receive your invoice by email and can download it on your order page.
5. Delivery
5.1After payment we show you the eSIM on your order page and send it to you by email, usually within a few minutes.
5.2We currently only sell to customers living in the European Union.
6. Fair use
6.1The plan is intended for your personal use in a smartphone or tablet. You can connect your own devices, such as a laptop or tablet, through your phone's hotspot.
6.2Not allowed are use in routers, mobile Wi-Fi devices, data sticks or other devices without their own screen, reselling or commercially passing on the connection, and use that disrupts the network, such as servers running continuously or automated mass requests.
6.3In the case of use under 6.2, the partner network may reduce the speed or block the eSIM. We will let you know as soon as we find out. If the block is due to use under 6.2, you are not entitled to a refund.
7. Right of withdrawal
7.1As a consumer you have a statutory right of withdrawal. The details and the model withdrawal form are in our withdrawal policy.
7.2You can also declare your withdrawal online, using "Withdraw from contract" at the bottom of every page and on your order page.
7.3We send you the eSIM right after your purchase. For this, when you buy, you expressly agree with a tick box that we start performing the contract before the withdrawal period ends, and you confirm that you know that your right of withdrawal therefore expires once we start performing the contract. Your right of withdrawal expires as soon as we show you the eSIM on your order page or send it to you by email. We confirm both to you in the order confirmation email.
7.4Independently of this, you get your money back as long as you have not installed the eSIM (section 8).
8. Money back if you have not installed the eSIM
8.1Voluntarily and independently of the statutory right of withdrawal: if you have not installed the eSIM yet, you get the full price back within 30 days of purchase. You can do this with one click through the link "Not installed? Get your money back" in your confirmation email or on your order page.
8.2We can see whether the eSIM is installed from the data of our network partner. With the refund, the eSIM is deleted and can no longer be used.
8.3We always refund to the payment method you paid with.
9. If the eSIM does not work
9.1Email us at hilfe@nobordersim.com. We first check two settings with you: data roaming is turned on for this eSIM, and the eSIM is selected for mobile data.
9.2If the eSIM still does not work and this is not due to your device or to use under 6.2, you get a new eSIM. If you have not used the eSIM yet, you can ask for your money back instead.
9.3This does not affect your statutory rights.
10. Liability
10.1We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act (Produkthaftungsgesetz).
10.2In the case of slight negligence, we are only liable if we breach an essential contractual obligation, meaning an obligation whose fulfilment makes the contract possible in the first place and on whose fulfilment you may rely. In that case our liability is limited to the damage that was typical and foreseeable when the contract was concluded.
10.3We are not liable for disruptions in third party networks for which we are not responsible.
11. Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. This does not affect your right to contact the telecommunications arbitration board of the Bundesnetzagentur (Schlichtungsstelle Telekommunikation).
